The Interplay between the AI Act and the GDPR: Part I – When and How to Comply with Both
In recent years, in particular following the emergence of large language models (LLM), the question of interplay between the contemplated EU regulation laying down harmonised rules on artificial intelligence (AI Act) and data protection regulations has become the centre of public debates for privacy professionals. At the time this first part of the study (Study) is drafted, the questions revolving around artificial intelligence (AI) governance and the compliance of ‘AI systems’, ‘general-purpose AI models’ and ‘general purpose AI systems’, as defined respectively under Articles 3(1), 3(63) and (66) of the AI Act, (altogether ‘AI system’), with the EU Regulation 2016/679 2 (GDPR) occupy an extremely important place for industry stakeholders. Notably, we became accustomed to having more than half of sessions of a generic privacy conference being dedicated to AI compliance and governance.
